The present terms and conditions of sale are available at all times and systematically brought to the attention of each customer/user to enable them to place an order. Thus, placing an order and checking the box "I accept the terms and conditions of sale" during the payment process implies the customer's full and unreserved acceptance of these terms and conditions of sale.
ARTICLE 1 - CONCEPT
NWO is a life-size and virtual reality escape game room owned by Fairycamp sas . These general terms and conditions of sale apply to any contract for the provision of a game room concluded between (1) any company in the Fairycamp sas group and (2) the users of the room, who will hereinafter be referred to as "USERS"; whether they have booked personally or are part of the team of the person who made the booking, hereinafter referred to as "THE BUYER". These conditions also apply regardless of the reservation method, whether the reservation is made via the Fairycamp SAS website, hereinafter referred to as the "WEBSITE", or with Fairycamp staff. The game space made available to players is referred to as the "ROOM" and the contract for making it available as the "CONTRACT". The game for which the BUYER books and pays on the WEBSITE is called a "GAME SESSION".
FAIRYCAMP SAS acknowledges the right to modify or have modified all or part of these general terms and conditions of sale as well as the content of its WEBSITE www.nowayout.fr, at its sole discretion, at any time and without prior notice.
The Fairycamp SAS general terms and conditions of sale are available on the WEBSITE and can be consulted on request from the FAIRYCAMP SAS reception staff.
ARTICLE 2 - AVAILABILITY AND USE OF THE HALL
according to the principle of the game, Fairycamp SAS grants USERS the right to occupy the ROOM for a period of approximately 60 (sixty) minutes. The sole purpose of occupying the ROOM is to participate in a game organized by Fairycamp SAS, which must be played alone or in a team of 3 to 5 people maximum.
USERS accept that they will be in the ROOM for approximately 60 minutes, whether or not they have managed to find all the clues and solve all the puzzles. This is part of the very principle of the game. At the same time, USERS accept that the game may end before the end of the 60 minutes, in particular if they have managed to find all the clues and solve all the puzzles in less than 60 minutes; without this being subject to any adjustment or compensation.
Admission to the ROOM is only possible on presentation of the reservation confirmation email (sent shortly after the payment process to the BUYER) and on presentation of the BUYER's ID.
The complexity of the game does not allow USERS under the age of 7 to participate. USERS under the age of 15 must be accompanied by an adult. USERS over the age of 15 need not be accompanied by an adult. In case of doubt as to the age of a USER, Fairycamp SAS reserves the right to request proof of identity. USERS are required to maintain the ROOM and all its equipment (non-restrictive list: decorations, furnishings, etc.) in good condition and to use it in accordance with its authorized use. Consequently, the USER acknowledges in the CONTRACT that any damage caused intentionally or by unauthorized handling of the room and its equipment will be billed.
Furthermore, the USER is obliged to use the ROOM and its equipment in such a way as not to cause or risk causing any damage to other USERS or to Fairycamp SAS premises and equipment.
While on Fairycamp SAS premises, the USER agrees to behave in a respectable manner, to abide by the rules and to cooperate with Fairycamp staff. As such, Fairycamp SAS does not tolerate any form of violence, be it verbal or physical, in the form of harassment or intimidation towards its employees and thus reserves the right to refuse access to the premises to any person whose behavior would resemble the aforementioned elements.
Fairycamp SAS also reserves the right to refuse access to any person under the influence of alcohol or drugs, as a safety measure for said person and his or her entourage. For all the above-mentioned conditions, refusal of access does not give the right to any indemnity or payment.
Due to the nature of the game, no recordings may be made in the ROOM. The use of video and/or audio recording devices (including but not limited to cell phones, cameras, Go Pro) is strictly forbidden. Any use of such equipment may result in a complete stoppage of the game for the entire team.
Fairycamp SAS expects its USERS not to disclose the details of the game directly and/or indirectly. Any partial or total disclosure would violate the commercial interests of Fairycamp sas.
ARTICLE 3 - PRICES
Prices charged by Fairycamp sas are indicated on the WEBSITE (on the home page and in the "missions" tab) and are also displayed at the reception desk. They are displayed in euros (€) including all taxes (TTC) for the general public and excluding taxes (HT) for professionals.
Price per person from approx. 60 minutes to 90 minutes. Excluding the price of the "DUO" offer. The price per session depends on the number of participants in the same team (2 to 6 people maximum). Prices vary according to day and time (off-peak/peak hours):
- 25 euros ( 6 players) to 42.5 euros ( 2 players) per player at peak times Monday, Tuesday, Wednesday, Saturday, Sunday from 1 to 7 p.m.
- 22 euros (6 players) to 42.5 euros per player (2 players), off-peak Mondays, Tuesdays, Wednesdays, Saturdays and Sundays from 10 a.m. to 1 p.m.
- 85.00 /per game for games with up to 2 players.
Water & soft drinks included...
- Escape maze 115 Euros per hour for weekly bookings.
- Escape maze 125 Euros per hour for weekend bookings.
Any other service or additional person will be invoiced additionally.
NWO/Fairycamp SAS reserves the right to modify its rates at any time. All BUYERS will pay the amount relating to the tariff in force at the time of their reservation.
ARTICLE 4 - RESERVATION
The provision of a ROOM is subject to prior reservation and payment. This is done by the BUYER on the WEBSITE of: all reservations of escape games are made from the WEBSITE and according to availability displayed on it. The reservation is firm and definitive only after receipt of the reservation confirmation email, which is sent to the BUYER at the end of the payment process. In certain exceptional cases, Fairycamp sas staff may make the reservation on behalf of the BUYER if the latter is unable to make the reservation on the WEBSITE. In such cases, the BUYER unreservedly accepts that Fairycamp sas or its staff will not be held responsible for this type of reservation, as the staff will only act as a data entry operator according to the BUYER's instructions. The BUYER hereby waives any recourse for misuse, breach of confidentiality or fraudulent use of his/her account.
Only credit card payments are accepted on the WEBSITE. If the BUYER is unable to pay by credit card, he/she must go to the Fairycamp SAS reception desk to pay the amount in euros by check, credit card or cash (in euros).
Fairycamp has entrusted the management of its payment platform to a service provider specialized in securing online transactions. The latter does not keep any data concerning the BUYER in its databases. The WEBSITE is available in French and English. However, in the event of a dispute, only the French version of the WEBSITE and the general terms and conditions of sale may be invoked against Fairycamp SAS.A reservation may not be transferred or resold for commercial purposes. If a reservation is transferred or resold in violation of this article, the holder of the reservation will be denied access.
If the USERS are late for a reserved SESSION, the USERS may decide whether or not they wish to start the game. In all cases, the ROOM must be vacated at the time specified in the initial reservation. Fairycamp SAS reserves the right to refuse access to USERS who are 15 minutes or more late. Schedules will be systematically reminded in the confirmation emails sent by fairycamp SAS.
If fewer USERS show up to take part in the PLAY SESSION than originally planned at the time of booking, the BUYER and/or USERS shall not be entitled to a refund of the difference in price.
If more USERS show up to take part in the game SESSION than were initially scheduled when the reservation was made, the difference in price must be paid before taking part in the game, within the limit of 5 players (USERS) authorized per ROOM.
Fairycamp SAS reserves the right to refuse any reservation to a PURCHASER who has not paid for all services invoiced.
Gift cards are valid for 12 months from the date of purchase and can be used in one go at www. nowayout .fr
The card's expiry date can be obtained by sending an e-mail to contact@nowayout.fr. At the time of purchase, please enter the PIN code shown on the card and, if necessary, complete it with your means of payment.
Gift cards may not be exchanged, resold, reimbursed (even partially), credited to a card or bank account, or discounted, and no change may be given. Several codes cannot be used for the same online reservation. However, it is possible to merge them if their amounts do not exceed the maximum amount of a game (125 euros) by sending us an e-mail to the following address: contact@nowayout.fr
ARTICLE 5 - RIGHT OF WITHDRAWAL
In accordance with article 221-28 of the French Consumer Code, no reservation may be cancelled or refunded. If the USER is unable to attend, he/she must notify FAIRYCAMP SAS at least 24 hours in advance so that the reservation can be rescheduled. No reimbursement will be made except in the exceptional case of a technical cancellation due solely to FAIRYCAMP SAS, and in this case only, the amount of the initial reservation will be reimbursed within a maximum of 180 days.
For gift cards and in accordance with the provisions of article L.221-18 of the French Consumer Code, in the case of distance selling, the purchaser has a cooling-off period of 14 days from receipt of the gift card by the Purchaser, or failing this, the Beneficiary, without having to justify his or her reasons or pay any penalties, with the exception of delivery and return costs, which will remain the responsibility of the Purchaser. (see 5.1 for full details).
5.1 Gift cards - Shop online purchase
The Purchaser, or failing that, the Beneficiary must inform FAIRYCAMP SAS of his decision to withdraw by sending a request within 14 days of the date of purchase and therefore before the expiry of the period provided for in Article L. 221-18, the form downloadable below or any other statement by email to contact@nowayout.fr, unambiguous and expressing his desire to withdraw.
All returns made in accordance with the terms of this article will be reimbursed within 180 days of receipt of the Gift Card, which must be in perfect condition.
As no return is necessary for electronic Gift Cards, reimbursement will be made within 180 days of receipt of the retraction request.
5.3 Gift cards - On-site purchase at NWO/FAIRYCAMP SAS
In the case of on-site sales of gift cards, the purchaser has a withdrawal period of 3 days from the date of purchase, without having to give any reason or pay any penalties, with the exception of delivery and return costs, which will be charged to the Purchaser in the case of a return by post. The Purchaser may also return the product directly to the address, taking into account the opening hours indicated on the site. Products must be returned in perfect condition, and returns will only be accepted after verification that the gift code(s) has (have) not been used.

5.4 Online reservations
In accordance with article 121-21-8 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the provision of accommodation services, other than residential accommodation, goods transport services, car rental, catering or leisure activities which must be provided on a specific date or at a specific time. Consequently, no reservation can be cancelled or reimbursed, except in the case of cancellation by Fairycamp SAS alone. In the latter case, the amount of the initial reservation will be reimbursed within 180 days.
ARTICLE 6 - TRACK RECORDS MONTH/WEEK
Every month, or every week, FAIRYCAMP SAS / NWO organizes the "Best of NWO Special Agents" operation. The aim of this operation is to highlight the individuals or teams with the highest scores for each of the 5 adventures offered by NWO, namely: Arsène Lupin's bank heist and Nicolas Tesla's impossible Laser Maze, Lost Pyramid, Meduza gate, Prince of Persia.
To take part, teams must complete the 2 missions and solve them in record time. This record time depends on the scores achieved by the other teams for the same Room during the current event.
Teams with the best times will be notified by email and via the social networks on which FAIRYCAMP SAS / NWO is present (notably Facebook and Twitter).
Each winning team in the "Best of NWO Special Agents" operation will then receive a voucher worth €30 for booking a new game session with NWO. This promotional code will be valid for 4 months from the date of issue and cannot be extended. If several teams achieve the same score for the same adventure, the tied teams will each receive a promotional code worth €30.
FAIRYCAMP SAS reserves the right to inspect the scores achieved by participants. Scores achieved in compliance with the instructions and rules of the game and of safety are considered as "records". NWO also reserves the right to interrupt or suspend this operation at its sole discretion, without justification and without prior notice.
ARTICLE 7 - PERSONAL DATA
7.1 What information we collect about you
The personal data we collect about you may include: your name, your e-mail address, your postal address, your telephone number, The BUYER is responsible for the accuracy of the information entered on the online booking form on the WEBSITE Information relating to persons under 16 years of age must be filled in with the consent of their legal guardian.
7.2 Why we collect it
The PURCHASER entering the contact details of other players/USERS (first and last names, telephone numbers, email addresses) authorizes Fairycamp sas to send information and commercial offers to them. The PURCHASER and/or USER who enters his/her telephone number on the Fairycamp sas WEBSITE hereby accepts to be contacted by Fairycamp sas by telephone or SMS. The BUYER accepts to receive information and commercial offers from Fairycamp SAS on his email address or cell phone by clicking on the authorization box on the WEBSITE.
7.3 We retain your personal data for as long as is necessary for the purposes for which we collected it, including the fulfilment of any legal or accounting requirements and any legal accountability obligations. Customer data is retained for the duration of the business relationship. This data may be kept for canvassing purposes for a maximum of 5 years from the end of the commercial relationship.
7.4 Information sharing
FAIRYCAMP SAS undertakes not to transmit the personal data of its USERS to any outside company, except at the request of an authority authorized by law and within the framework of the legal provisions in force. Only authorized employees are able to access personal data, and they may only do so for legitimate business purposes. In addition, we use encryption when transmitting personal data between your system and ours, and between our system and that of parties with whom we share confidential information.

You may have the following rights in relation to your personal data: The right to request access to your personal data. The right to request the deletion of your personal data if it is no longer required for the purposes for which it was collected or processed.

ARTICLE 8 - SAFETY
The USER agrees to abide by all security measures given to him/her, whether they are contractual, posted on site or given orally by Fairycamp SAS personnel.
Smoking is strictly prohibited inside the site.
Each USER agrees to read and respect the safety and fire protection instructions, as well as the emergency exits. These are clearly identified in the Fairycamp SAS premises. It is strictly forbidden to obstruct the emergency exits, which must remain clear at all times. The USER may use the emergency exits if and only if the situation requires evacuation of the premises (e.g. fire). Any abuse and/or untimely opening of these exits by one or more USER(S) will result in the re-invoicing of the costs incurred by this abuse.
The USER is aware that it is absolutely forbidden to bring onto the premises and into the ROOM items considered to be (1) physical hazards (explosive, flammable, oxidizing, pressurized or liquefied gas, corrosive), (2) hazardous to health (toxic, corrosive to the skin, irritant/sensitizer, carcinogenic/teratogenic) and (3) hazardous to the aquatic environment.
ARTICLE 9 - IMAGE RIGHTS
Photos of each USER team may be taken before or after the game session. These photos may be used by Fairycamp sas to feed its WEBSITE or its social networks (Facebook, Twitter, Instagram etc.). These same photos will be sent by email to the USERS within a reasonable time after the game session. Fairycamp SAS cannot be held responsible for the use that will be made of the photos by the USERS and/or the BUYER.
Each ROOM is equipped with a video surveillance and listening device that allows Fairycamp sas staff to monitor the gaming session and refer USERS if necessary. This device only contributes to the game and does not record the USERS' gaming SESSIONS.
ARTICLE 10 - MEDIATION
In accordance with article L. 152-1 of the French Consumer Code, you may contact the MEDICYS mediation service, of which we are a member, free of charge, either electronically at www.medicys.fr or by post at MEDICYS - 73 Boulevard de Clichy - 75009 PARIS, for any claim. Please note that recourse to mediation is only possible on condition that your complaint has not already been examined by a judge or another mediator, and that it has already been the subject of an appeal to our Customer Service department. Mediation does not apply to disputes between professionals.
ARTICLE 11 - COMPETENT COURTS
These terms and conditions are governed by French law and any disputes shall be submitted to the jurisdiction of the French courts.
